Hereafter referred to as Dog. The Breeder guarantees the Dog as follows:

To the best of the Breeder’s knowledge, this Dog is free of communicable diseases and birth defects and at time of sale the Dog was in excellent health. The Dog has received appropriate vaccinations and care to date. Buyer will be supplied with the Dog’s medical records.

Breeder is selling this Dog specificallyfor home pet/companion purposes. Buyer agrees to take the Dog to a licensed veterinarian within 72 hours after taking possession for a general health exam. If during this health exam the Dog is found to have a life-threatening health problem, the Buyer must return the Dog with the Veterinarian’s written confirmation as to the health problem. Upon return of the dog along with the written Vet confirmation, the Buyer will receive another Dog of equal value if one is available. The puppy will be replaced with the next available puppy of same value (may take up to 1 year). Return of the Dog must be done within the 48 hours of Buyer’s Vet’s determination; otherwise, the Buyer forfeits any replacement of the Dog. No cash refunds will be given and under no circumstances will the Seller be responsible for veterinarian fees, transportation costs, or refund of any costs after the final purchase.

Breeder is not responsible for any charges incurred in returning or replacing the dog.  Seller will not provide a refund or exchange for any Dog injured or becoming sick (due to non- genetic disease) after leaving the Breeder’s premises. Seller will not be responsible for illness or injury due to neglect by Buyer. Seller will not be responsible for placement of teeth (bite) or undescended testicles.

Buyers are required to limit the exposure of their Dog to other dogs and stay away from high traffic dog areas (no pet stores or dog parks) until the puppy is at least 16 weeks old and/ or has been given its final puppy vaccination. This is extremely important. Err on the side of caution and do not risk the health of your puppy.

This Dog is being sold with the agreement that it is being placed with a Buyer who promises the Dog will become a member of the family and will primarily live indoors as a member of their family and commits to providing a responsible home for puppy.

Seller does not guarantee size or color as your puppy matures to adulthood. Buyer agrees to maintain preventative health care of the Dog including, but not limited to: annual vaccinations, treatment as needed for internal and external parasites, and heart worm preventative  medication. Coccidia, giardia, ear mites and internal parasites are not covered under this guarantee. Seller does not guarantee against common conditions; luxating patella, open  fontanel, hernias, ear infection, vaccinosis, malnutrition, diarrhea, missing or misaligned teeth or alopecia. Any damage to the immune system or major organs caused by vaccine reactions or hypoglycemia is not covered under this guarantee. Under no circumstances will the breeder be responsible for the dog’s temperament, behavior or appearance. Toy breeds sometimes need retained puppy teeth extracted if they do not fall out on their own. Seller cannot guarantee “bites” or exact adult size or weight.

It is the Buyer’s responsibility to make sure the puppy eats every 3-4 hours (hand feed if necessary) and give Nutri-Cal or Nutri-Stat gel every 3-4 hours if puppy is not eating well. Buyer must not let the puppy tire itself out or become chilled, and to provide immediate veterinary assistance if puppy shows signs of hypoglycemia. Seller does not guarantee against HYPOGLYCEMIA. Separate information will be provided on Hypoglycemia, please take this very seriously as it can mean life or death.

Buyer agrees to have this dog neutered or spayed by the age of 1 year. AKC registration or ACA papers (if applicable) will be forwarded to Buyer once verification of spay/neuter procedure has been performed on said puppy. Veterinarian statement to be mailed to Breeder. Buyer promises that said puppy shall not be placed in an animal shelter or pet store, left outside for extended periods of time, or confined to a cage that is too small for the puppy to be comfortable. If Buyer should need to sell or re-home puppy at any time, buyer agrees to notify breeder and allow breeder to retake possession of said puppy at no cost to the breeder.

Buyer understands that this guarantee is with the original purchaser of the puppy and is a non-transferable contract. Buyer agrees that this contract is under the jurisdiction of the state of Texas. All deposits received from buyer are non-refundable. Balance between the deposit and total price (final purchase price) must be paid before or on the date of pickup. Failure to comply with the terms of this agreement deems this guarantee null and void.

Seller assumes no liability for injury or death of a puppy while in the care of anyone other than Seller.

Buyer acknowledges that all risk of loss due to illness or injury of said puppy shall remain upon Buyer.

Buyer agrees to conduct him/herself as a responsible dog owner and if there is any question regarding the health and safety of said puppy, Buyer will seek veterinary assistance immediately.

I (Buyer) have read and agree to the terms of the above contract. I (Buyer) understand that no other guarantees are meant or implied other than what is stated in this contract. I (Buyer) understand and agree that Carisma Maltese (Breeder) is not responsible for any veterinarian expenses incurred in connection with this puppy once Buyer takes possession of said puppy. I agree to abide by the terms of this agreement.
